I write this story with prayer to all other's who can relate and have concerns of how our judicial system operates, on the interest of our welfare and the welfare of our children, the future of our country. Young Nicolas was born to an American mother and a Mexican born father who came into the United States illegaly. Nicolas has always had a happy and healthy home, until things turned ugly with his father who became caught up in the middle of a family drug business that was run by his fellow illegal family members residing in our great USA. Nicolas who lacks for nothing and has never lacked for the smallest want or need was always cared for and nurtured properly by his mother, always putting his safety first. His father with a long history of infidelities and scandelous and harrasing women who he would manipulate into doing his bidding with a undermined plot in discrediting Nicolas's mother by using all agencies that are involved with CPS(DHS) assessments, to kidnap his son to take him to Mexico. The motive of indiscretion by the father later proved discovery and motive over a period of years, in order to arrange this properly. In December of 2008, Nicolas resided with his parents in their home, his mother made sure the christmas decorations were up, that the home atmosphere was happy and that it was most important to value each day as a growing experience, until their house was raided and drugs were found in a spare room where Nicolas's father had been hiding them, along with scales, bags ect. Medford Police Gang Enforcement confinscated drugs from the home, when CPS was called, that was the moment Nicolas and his mothers wish for a happy holiday and a life together sadly came to an end. Nicolas went to live with his mothers parents, two very caring and nurturing individuals with plenty of stability, safety, security and Space as well as a wonderful social relationship of trust with their grandson. The father was told by a CPS caseworker not to work with a member of Gang Enforcement, which the father didn't abide to, leaving a taste in the mouths of many in the drug dealing world of a "rat", in the midsts. Nicolas being removed from the home was immidiatly removed from any danger, by any threat of harm that may come however, his mother who at the time was 3 months expecting her second child was left alone and abandoned by Nicolas's father when the threat of endangerment found him at his residence, leaving that residence to another family that he had on the side where two other small young children reside. Since, the father has worked diligently abusing "Good Faith Reports", of Abuse to CPS(DHS), not on the safety of his child, or other children specifically against his own wife and the question in hand the safety factor of the child when the child is left in her care. Members of the Jackson County Community were outraged when not only did they know of possible threats of harm on Nicolas or his mother, but that the biggest threat of harm was perpetrated and is continuing to be perpetrated by the father against his wife, but why exactly is the question in mind. Motive? sure, a pregnant wife who he wants rid of, a beautiful child with a brand new life with a new woman, and family, Fortunatly that was enough motive for Scott Peterson to be convicted, but the bigger question in mind how have our own state agencies contributed and aided in the fathers, coersiveness and dedication to exercising his rites as a father even though unlegal to strip the legal caring mother of her rights by any means? 1. Jackson County DHS (CPS), has recieved multipule counts of false reports against Nicolas's grandparents and mother, most allegations coming from direct people in association with the father. When asked by a close friend of the families, it was said " Medford is small, word gets around fast", CPS also refuses to look at the fact that a father who is in juvenile court with a conviction of endangerment and neglect has willingly and knowingly resided and been caring for two other underaged children putting them in the imminent danger of his enemies in the drug world, once apart of and then turned on. CPS, doesn't feel the imminent danger due to circumstance that the father has, CREATED, along with coercivness with his new significant other, why are these poor children not in question? The mothers ability to care for these children allowing them to associate with a known drug dealer, who has lost his own child to the State because of this fact? With this on basis of in-factual evidence every bit of light to be shined, is now focused on the mother who has always had her childs interest at heart, the father and his co-conspirators even going as far as to manipulate DHS to discredit the grandparents where Nicky is safe and happy for DHS to threaten to remove Nicolas from the home if Nicolas's grandmother continued to have contact with her abandoned, frightened, scared and expecting daughter who has complied with all of DHS, wishes to gain back custody of her son. Why? Grounds? Protocall? This is nowhere to be found as part of a proper assessment in the DHS handbook, or guidlines at all. 2. Medford Police Department has refused help to Nicolas's mother due to the harrassment of the fathers, infidelities and affairs with other women, leading up to harrassment in the past. Nicolas's mother always sent Nicolas with his grandparents when there was a threat of harm to her son, from any of these other women,or their families. Police grew tired of, Help, Help Help I just want it to stop, the threatening phone calls? telephonic Harassment! Writing on the doors? Vandalism, the following repeatedly? Stalking, the following after a stalking order had been issued against predators? violation of stalking order, what was done? NOTHING! Why? Nicolas's mother was told by a MPD sargeant that the father was the reason why these things had been going on and going on, to cause the drama and turmoil into the home, but ihere is the true question, since the first report in 2005 when Nicolas's father was told he was the problem and cause of his misfortunate events that were happening by acts of women scorned, why find more to add to the heap pile! Why manipulate more to help him, be saved? Saved from what? How many times has the American public seen a Mexican illegal alien marry an American Citizen and have a ligitimate child with the sole intentions of filing for citizenship then leaving the family? Many! Statistics prove to be outstanding! MPD, agrees with DHS? Or they just arent doing their jobs either jeapordizing not only the safety of little Nicolas but now 2 other young small children... 3. Gang Enforcement! Would use an illegal as an informant!? To avoid what? Helping this illegal? giving him waiver to laws, the thinking that he is an illegal and the laws just don't apply to him? Yes, that is exactly what happened, and because of that an innocent women lives in fear everyday, while pregnant and fighting for the right of her child. My question is this, The mother is not allowed to see Nicolas other than at a supervised visitation as so the father as well, one day a week for one hour!? OBSURD!She is not allowed to have un-supervised contact with Nicolas, DHS claims due to the fear of somone finding Nicolas that could place him in imminent danger or in a threat of harm because of fathers work with Gang Enforcement, and association with drug affiliated people! These other two children are of no consequence to DHS, I guess people with a vendetta are selective? only poor Nicolas is in danger? I see derelect and Agencies hiding behind and depending on the support of other agencies, I see neglect comeing from DHS themselves. 4. Mexico. DHS Sent a small young girl to Mexico from a caring foster home rite here in Oregon, where later that little girl died! Why? Undeterminded causes Mexican death Certificate says, when concerns that father had a plot to kidnap his son was brought to the case workers attention, she stated that DHS has a very close working relationship with Mexico! yes, indeed close DHS is having all kinds of legal reprecustions from that iresponsible stunt, so it's okay if Nicolas ends up in Mexico? Pr has his father just manipulated them enough into thinking that;s just not a possibility. Someone who has no moral code nor ethic for the simple law of Border Patrol, for illegaly driving with out a valid lisence, using false social security numbers to work under, being employed by family and hiding behind our States Lisencing board to use their vehicles in transporting drugs, they aren't taking more of a concern in him why? I question the caseworkers capacity in this case, there should be no double standards whatsoever, nor sides. It should be fair, all evidence should count with an explination from both sides, from my understanding thats not happening the father has more rights, or is just simply being allowed to exercise them a whole lot more than Nicolas's mother, or grandparents.I feel for this family, for Nicolas when he turned 3 that his father didn't even bother to call to wish him a happy birthday, that the grandparents who have been apart of his life since birth would be discredited by members of Jackson Counties Law enforcement officials, based on the manipulation of a Mexican citizen, who is here illegaly is unbeleivable and doesn't inspure much faith in prosecition, defense, discovery nor a proper assessment given to this family. 5. Nicolas mother, was cleared on 3 mental evaluations to be completely compitent, now another one is being requested. How many times does one have to be assessed? until DHS, gets back the negative results they are looking for! There would be no other reason, a drug assessment that showed Nicolas's mother to be a victim of abuse inflcted by her husband, that there is no concerns of imminent danger or risk from the mother to the child, yet the mother is not allowed to see the child on a regular basis now the grandparents arent allowed to take turns in spending time with their daughter to help her through this rough time. Imagine your husband left you alone, pregnant completely open to the fact that predators are looking to hurt anyone associated with someone who turned on them and could have possibly given their name to any member of law enforcement, that your not allowed to spend the time with your parents, even if its not around your chid, your husband being allowed by the agencies to manipulate the entire situation to his benefit of taking the child, deviding and conqering with set ups and so on, false reports it just doesnt end. I could't imagine first hand how this woman has held it together, but I look at that black and white picture at the top of that page and I see innocence, I see beauty I see potential I see eyes of hope, I hear cries of try mommy, try harder to come home, I'll save you mommy, that would be enough for me and Im not even the mother. I can only imagine the turmoil of this family.
I pray that Nicolas will be able to reside with his mother in the near future with her parents, with out worry of an estranged maniac, I pray that the other two children are never subject to the threat of harm, I hope that someone somewhere sets this double standard straight to keep those children just as safe as Nicolas, I hope that DHS steps back and starts to realizze what this story is about, because I'm not questioning the mothers, nor the grandparents capabilities to care and provide safetly for the child, my question is if DHS and their "qualified CPS-workers" are. If, their judgement calls wont be noted and have been through the entire case, because this is injust and unfair, thats our system folks, another innocent child victim to neglect, only yet again must I stress from our State Department this time!
God Bless Nicolas, that he may have a good life with his mother and Grandparents, that he is kept out of danger and that the threat of that beautiful child wont end up in Mexico, where he would never be found or heard from again, that the father stops endangering other children as he endangered his own, that the other woman in quesiton at this time is assessed to the fullest on her parenting skills and priority levels between her blood children and a known drug dealer and person who has been convicted of neglect and abuse, that DHS will assess and make more healthy and productive case planes, that the Boards make sure that proper protocall is taken, and most of all over anything that Nicolas's mother can carry her child that she is carrying to full term, with no complications of any of this stress being inflicted and allowed to be carried on by her husband, his friends, family and foe's, and DHS along with MPD, I pray this family will be reunited and blessed, with a hard lesson learned, but a brave battle faught. |
